Naxiator.com reserves the right to:
- change or remove naxiator.com (temporarily or permanently) without notice and you confirm that naxiator.com shall not be liable to you for any such change or removal.
- change these Terms and Conditions at any time.
3. LINKS TO THIRD PARTY WEBSITES
Naxiator.com may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.
4. COPYRIGHT
All copyright, trademarks and all other intellectual property rights on naxiator.com (including without limitation the website design, text, and all software and source codes connected with naxiator.com) are owned by or licensed to naxiator.com or otherwise used by naxiator.com as permitted by law. In accessing naxiator.com you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the website for personal, non-commercial home use only.
5. DISCLAIMERS AND LIMITATION OF LIABILITY
The functionality of naxiator.com is depending on the format of the fetching source (e.g. airline company portal). If this source changes or does for any other reason not interact with naxiator.com as desired, naxiator.com will try to solve this, but if this takes time or is not achieved at all it will not entitle you to any legal claim against naxiator.com. Naxiator.com is provided on an AS IS and AS AVAILABLE basis and we are not liable if a roster is interpreted with incorrect data. You must use your official roster as your definite source of information. Naxiator.com will not be liable for any accidental or intentional deletion of data on our servers. Do not use naxiator.com with the intention of storing/logging data for permanent use as it may be deleted without warning. Naxiator.com makes no warranty that the functionality of our service will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive. Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of naxiator.com for death or personal injury as a result of the negligence of naxiator.com or that of its employees or agents. By using naxiator.com you accept that your are legally permitted to do so and have received the relevant permission from any relevant parties.
6. INDEMNITY
You agree to indemnify and hold naxaitor.com and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against naxiator.com arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of naxiator.com.
7. SEVERANCE
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
8. SUBSCRIPTION
We offer all Norwegian crews a service free of charge. We reserve the right to suspend the service for individuals or as a group or to require a subscription for further use. No plans exist for a subscribed naxiator.com service at the time of t&c review.
9. SUSPENSION OF USE
Naxiator.com reserves the right to permanently or temporarily terminate, suspend, or otherwise refuse to permit access to the product without prior notice and liability, if, in naxiator.coms’ determination, the user is considered to be violating any of the Terms and Conditions. Under no circumstances shall Naxiator be used to hunt down other colleagues with the intention to put the other pilot in bad light. Any such use will ultimately lead to a temporary or permanent suspension from the baseroster, crew on board and any pages that contains gdpr sensitive information.
10. PRIVACY POLICY
The General Data Protection Regulation (GDPR) is the most comprehensive EU data privacy law in decades, and will come into effect on May 25th, 2018. Besides strengthening and standardizing user data privacy across the EU nations, it will require new or additional obligations on all organizations that handle EU citizens’ personal data, regardless of where the organizations themselves are located. Naxiator.com is GDPR compliant as of May 25th 2018.
The GDPR outlines two types of personal information:
- Sensitive personal data (data consisting of racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, biometric data, data concerning health or data concerning a natural person's sex life or sexual orientation.). Naxiator does not request or store any sensitive personal data.

WHAT PERSONAL INFORMATION NAXIATOR.COM COLLECT
We require storage of the following personal data on our servers:
- Name.
- E-mail address.
- Phone number.
- Crew number (Norwegian).
- Crew authentication (for access verification to naxiator.com and fetching of current roster data).
- Crew rank.
- Birthdate.
- Naxiator password.
- Usage of the Naxiator.com service for statistical purpose.
- Homebase and base of preference.
- Roster data.
HOW NAXIATOR.COM COLLECT THE INFORMATION
The user provides the personal data when entered during registration and changed in the settings section of the website by the user. The naxiator.com server runs a service to collect and refresh roster data on a regular endless loop. This refreshing of roster data is made based on the users inserted personal data.
WHY NAXIATOR.COM COLLECT THE INFORMATION
- Name – to identify the crew.
- E-mail address - to provide a password reset function and to notify about roster changes or other system related messages.
- Phone number - optional, and is used in a contact feature for those allowing this in their privacy settings.
- Crew number and password – to make naxiator.com able to retrieve and process your roster.
- Crew rank - to make the roster data appear in the right category (base roster and crew composition lists).
- Birthdate - for the seniority list project.
- Naxiator password - to authenticate your right of access to naxiator.com.
- Statistics - to prioritize further development and performance improvement.
- Homebase and base of preference - base bidding project.
- Roster data - the backbone of naxiator.com used in: personal roster replication, baseroster, crew-on-board, swap functionality, personal flight history.
HOW WE USE IT
Combination of the data collected as mentioned above. To produce; baserosters, flight history, base statistics and detailed overview, swap requests, personal rosters, friends roster, public roster (optional), crew-on-board lists.
Except for the group functionality mentioned aboved, we do not share your data to any 3rd parties. We do inhouse backups.
A basic principle for Naxiator.com is that only active crews belonging to Norwegian shall have the right to create a user with access to Naxiator.com. Retired or redundant crews will not have access to Naxiator from the moment Norwegian removes their access to the internal systems.
HOW WE SECURE IT
Naxiator.com use a COMODO Secure Socket Layer (SSL) 256-bit with RSA encryption (https).
The Naxiator.com is built on a “privacy by design” principle to prevent unauthorized access to personal data. Except for the public roster (optional), no personal data is made available unless the client is properly identified as an authorised user by naxiator.com.
All servers are physically secured.
If a breach of security which can result in a risk of personal data theft is discovered, you will within 72 hours be contacted through email, phone (if provided) or a general notification on naxiator.com.
ANY THIRD PARTIES WITH ACCESS TO IT
NASimport (iOS app) has implemented an autologin feature giving quick access to naxiator.com if the user insert their naxiator login details. )optional)
Any other approved and active naxiator.com user will be able to view your basic roster data through the baseroster, friends roster and swap feature. No user will be able to see your roster data without also sharing his/her own roster data.
USE OF COOKIES AND SESSIONS
We do use server-side sessions to maintain your login status and to display the correct content on your session. We do not store client side cookies.
HOW USERS CAN CONTROL ANY ASPECTS OF THIS
By contacting us on post@naxiator.com you can at any time:
- request access to all information that naxiator.com has on you.
- correct any information that naxiator.com has on you.
- withdraw your consent to the storage of personal data. In this case we will delete all information that naxiator.com has on you and you will no longer have access to naxiator.com.
